Digital Licence Agreement

This agreement sets out the terms on which Timani Nairana Art ("Nairana Art", "we", "us") licenses digital artwork and pattern files to you ("the Licensee") when you purchase a digital product from this website.

This is a starting template. Before publishing this page live, we recommend having it reviewed by a qualified Australian solicitor to make sure it fully protects your rights as the artist.

1. Ownership & Copyright

All artwork, patterns, and designs remain the intellectual property of Timani Nairana Art at all times. Purchasing a digital file grants you a licence to use the artwork under the terms below — it does not transfer copyright or ownership of the underlying artwork to you.

2. Licence Types

Each product is sold under one of the following licence types, as stated on the product page at time of purchase:

Personal Licence — for personal, non-commercial use only.
Small Business Commercial Licence — for use by small businesses within agreed production limits.
Commercial Licence — broader commercial use as agreed at time of purchase.
Exclusive Licence — sole use rights for an agreed period or purpose, negotiated directly with the artist.

3. Permitted Use

You may use the licensed file for the purpose stated in your licence type, including printing, manufacturing, or digital use within the agreed scope. The licence period, where applicable (e.g. a 12-month licence), begins on the date of purchase.

4. Prohibited Use

Reselling, redistributing, or sharing the original digital file as a standalone product.
Claiming the artwork or design as your own original creation.
Using the artwork in a way that misrepresents its cultural story or significance.
Using the artwork beyond the scope or quantity limits of your licence type without separate written permission.

5. Cultural Integrity

Many of the designs available through Nairana Art carry cultural stories connected to Country and family. Licensees agree to use the artwork respectfully and not to alter, distort, or recontextualise the artwork in a way that misrepresents its cultural meaning.

6. Refunds & File Delivery

Digital files are delivered automatically by email/download after purchase. Please see our separate Refund Policy for details on refunds and faulty file replacement.

7. Termination

Nairana Art reserves the right to terminate a licence if these terms are breached, without obligation to provide a refund.
